Another Reason to Vote for Joe Biden and Mark Kelly: The Courts

Two events related to the Judiciary occurred this week give more reasons for Democratic-leaning voters to turn out en masse this November and vote for Joe Biden and Mark Kelly.

The first is Associate Justice Ruth Bader Ginsburg. She was in the hospital again for a gallbladder infection. In 2019, she had treatment for a tumor in her pancreas. In 2018, she had “two cancerous nodules” removed from her lungs.

Justice Ginsburg is 87 years old.

Justice Stephen Breyer is 81.

Justice Clarence Thomas is 71.

Justice Samuel Alito is 70.

Does the reader see a reason to worry about what could happen if 2016 Popular Vote Loser Donald Trump wins a second term or Enemy of the People-Political Prince of Darkness Mitch McConnell either wins reelection and/or maintains his status as Senate Majority Leader?

The other event and the real reason Legislative Grim Reaper Mitch McConnell, despite health risks for his members, called the Senate back into session was for the Senate Judiciary Committee to consider the nomination of his protege, Judge Justin Walker for the D.C. Circuit Court of Appeals.

The 37-year-old Walker has served only six months in his current judgeship. He is the latest person in Supreme Court Justice thief Mitch McConnell’s to reshape the federal judiciary into a reactionary fringe love fest.

The reactionary Walker, a former clerk for Justice Anthony Kennedy and Brett Kavanagh (when he was on the DC Circuit,) earned condemnation from some left of center legal circles (and praise from right-wing ones) just weeks ago for ruling that the Mayor of Louisville Kentucky erred by imposing restrictions on Easter Services during the middle of the Coronavirus.

While his likely confirmation to the DC Circuit will not alter the ideological configuration of that court, he will likely occupy that seat for the next 45 to 50 years since this is a lifetime appointment.

This is another example of why it is vital to elect Joe Biden to the Presidency and for Democrats to retake the Senate with candidates like Mark Kelly in 2020.

If Biden and his team are diligently planning for who to nominate for Vice President and other members to serve in his administration, hopefully, they are also vetting judges to put on the federal bench should they win office.

Reusing the confirmation rules McConnell set up for judicial nominations should be maintained by Democrats so the judiciary choices of this current administration are counterbalanced and the people see a court that reflects them not the reactionary fringe.

Democrats should also learn from Republican Governors like Doug Ducey who engaged in a packing scheme, with the help of the reactionary fringe in his party, on the Arizona Supreme Court. 

After all, imitation is the sincerest form of flattery, and turnabout is fair play.

The American People should not be asked to risk their lives like warriors so Donald Trump can improve his Reelection chances.

While visiting the Honeywell plant in Phoenix, a maskless Donald Trump (along with his team) and masked Arizona delegation (led by Governor Doug Ducey) were treated to various musical numbers on the plant loudspeaker. Among them were God Bless America, Eye of the Tiger, and the Guns and Roses version of the Paul McCartney James Bond song “Live and Let Die.”

For commentators, it does not get any better than that to describe the coincidence (maybe) of that song playing while more state leaders (both Democrat and Republican) including Governor Ducey are following the examples of Georgia, Colorado, and Florida and starting to ease Stay at Home guidelines in varying phases despite the facts that no state, including Arizona, has:

• Had a decline in Coronavirus cases for 14 days straight.
• An adequate supply of testing equipment for a substantial part of their population.

Some of these states, including Arizona, have not peaked in COVID 19 cases yet.

Many scientists warn that reopening too soon may cause a large influx in Coronavirus illnesses and make the socio-economic situation worse than anticipated.

Despite that, the White House announced (and Trump later backtracked) that the Coronavirus task force would disband by Memorial Day.

In Arizona, Governor Ducey and his team told the specialists at Arizona State University and University of Arizona that they no longer needed to create models of COVID-19 progress.

Why?

Dr. Randy Friese, a State Representative from Legislative District Nine in the Tucson area wonders why. He tweeted after hearing Governor Ducey’s announcement to reopen salons and restaurants this coming weekend:

“Downward trajectory of +tests?? With 1,000 new cases this weekend? That’s a 14% increase in 48hrs. If that’s downward we are in the #UpsideDown and #StrangerThings are in our future. We are only fooling ourselves. #COVID will not be fooled. We have not yet met criteria 

@dougducey”

Is putting people in harm’s way to improve quarterly bottom lines and possibly one’s election prospects more important than a high body count?

Republicans  may want to make the song “Live and Let Die” their new battle cry along with reworking the credited Patrick Henry quote to “Give me Liberty, Death, and the Almighty Dollar.”

This potentially cavalier attitude towards preserving life has been encapsulated by formerNew Jersey Governor Chris Christie who commented on a podcast with Dana Bash that an increase in people dying of the Coronavirus during the county reopening is similar to those soldiers who sacrificed their lives for the American way of life during World War Two.

Really.

Soldiers dying to save the country from Fascism is on the same level as Starbucks needing to improve their profit margin for the second quarter.

I do not think so.

The Stable Genius, while in Phoenix, commented:

“Will some people be affected? Yes. Will some people be affected badly? Yes. But we have to get our country open and we have to get it open soon.”

The country needs a leader who puts lives first instead of a nation’s G.D.P. or job creation numbers.

Everyone wants life to return to normal.

Unfortunately, the data in testing and decline in cases is not there to justify a decision to reopen on a large scale, especially when it will be difficult to monitor every beach, salon, restaurant, or store to ensure they are following social distance guidelines.

Difficult as it is, being cautious and waiting for the data is more prudent than prematurely reopening and risking more lives.

Actually taking steps (on a national level in coordination with the states) to make sure everyone is tested and safe is more advisable than to ask people to chance to go to sit in McDonald’s and pray the person ordering next to them is not ill.

If New Zealand can do it, why not the United States?

The American People should not be asked to risk their lives like warriors so Donald Trump can fight this virus on the cheap and improve his Reelection chances.

Forget Dr. Anthony Fauci; Let House Members hear what Dr. Rick Bright has to Say

Like a petty pampered juvenile, the 2016 Popular Vote Loser will not let Dr. Anthony Fauci testify before the House of Representatives because:

“The House is a setup. The House is a bunch of Trump haters….They frankly want our situation to be unsuccessful, which means death….. so they can win an election.”

Fauci will be able to testify before the Republican-controlled Senate where the Democrats there will undoubtedly ask similar questions their House colleagues would have.

Perhaps House members should channel their investigative tools and resources towards summoning Dr. Richard Bright, the former Director of BARDA (Biomedical Advanced Research and Development Authority) who was removed from his position last month.

Dr. Bright has just filed a whistleblower complaint and issued a statement in a teleconference that accuses the Administration of ignoring scientific evidence and rewarding contracts based on political considerations and crony interests.

In the teleconference, Dr. Bright said that this problem did not surface with the peddling of hydroxychloroquine as a miracle drug to treat the Coronavirus. It has been going on for the last three years (which coincides with the arrival of the Trump Administration.)

In filing his whistleblower complaint, Dr. Bright wants a special counsel to investigate his complaint. He also demands his immediate reinstatement as the Director of BARDA so he can help lead his team again in using scientifically proven methods to treat the Coronavirus.

The House should subpoena Dr. Bright right away as well as Fauci. One of them will probably show up like the many who defied White House instructions to testify before the Impeachment Inquiry.

They should not let up on this.

This is another example of the corrupt science-denying incompetent governing sewage that is the Trump Administration.

It is another reason for voters to look for a different option to elect to the Presidency in November 2020.
