Another Reason to Vote for Joe Biden and Mark Kelly: The Courts


Two events related to the Judiciary occurred this week give more reasons for Democratic-leaning voters to turn out en masse this November and vote for Joe Biden and Mark Kelly.
The first is Associate Justice Ruth Bader Ginsburg. She was in the hospital again for a gallbladder infection. In 2019, she had treatment for a tumor in her pancreas. In 2018, she had “two cancerous nodules” removed from her lungs.
Justice Ginsburg is 87 years old.
Justice Stephen Breyer is 81.
Justice Clarence Thomas is 71.
Justice Samuel Alito is 70.
Does the reader see a reason to worry about what could happen if 2016 Popular Vote Loser Donald Trump wins a second term or Enemy of the People-Political Prince of Darkness Mitch McConnell either wins reelection and/or maintains his status as Senate Majority Leader?
The other event and the real reason Legislative Grim Reaper Mitch McConnell, despite health risks for his members, called the Senate back into session was for the Senate Judiciary Committee to consider the nomination of his protege, Judge Justin Walker for the D.C. Circuit Court of Appeals.
The 37-year-old Walker has served only six months in his current judgeship. He is the latest person in Supreme Court Justice thief Mitch McConnell’s to reshape the federal judiciary into a reactionary fringe love fest.
The reactionary Walker, a former clerk for Justice Anthony Kennedy and Brett Kavanagh (when he was on the DC Circuit,) earned condemnation from some left of center legal circles (and praise from right-wing ones) just weeks ago for ruling that the Mayor of Louisville Kentucky erred by imposing restrictions on Easter Services during the middle of the Coronavirus.
While his likely confirmation to the DC Circuit will not alter the ideological configuration of that court, he will likely occupy that seat for the next 45 to 50 years since this is a lifetime appointment.
This is another example of why it is vital to elect Joe Biden to the Presidency and for Democrats to retake the Senate with candidates like Mark Kelly in 2020.
If Biden and his team are diligently planning for who to nominate for Vice President and other members to serve in his administration, hopefully, they are also vetting judges to put on the federal bench should they win office.
Reusing the confirmation rules McConnell set up for judicial nominations should be maintained by Democrats so the judiciary choices of this current administration are counterbalanced and the people see a court that reflects them not the reactionary fringe.
Democrats should also learn from Republican Governors like Doug Ducey who engaged in a packing scheme, with the help of the reactionary fringe in his party, on the Arizona Supreme Court. 
After all, imitation is the sincerest form of flattery, and turnabout is fair play.
